Partner Visa

Want to apply for a partner visa and looking for help then you are in the right place. Here we will guide those of you who are thinking of applying for a Partner/ Spouse /De Facto visa. To qualify and apply for a Partner Visa Australia, you have to be either;
  • Married to
OR
  • In a de facto relationship unless exempt
With Australian Citizen, Australian Permanent resident or Eligible New Zealand Citizen at the time of applying.
If you lodge a Partner visa whilst onshore (in Australia) you will get a Bridging visa associated to it. Note that there could be limitations on being able to work or Study. This will be dependent on the previous visa you held and if you had work or study rights on that visa. If you are lucky enough to have had those entitlements then when your previous visa expires, the same conditions would continue on the Bridging visa associated with your partner visa. During your wait for a Permanent partner visa (subclass 100 or 801) you would not be able to receive fee assistance such as HECS or Newstart or other government subsidies.

Partner (Provisional and Migrant) visa (subclass 309 100)

This visa is for Offshore applicants. This visa allows the partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia.
You apply for the temporary and the permanent partner visas together. 
For you to apply to this visa, you must be in genuine relationship with your spouse or de facto partner who is:
 
a) An Australian Citizen
b) Australian permanent resident
c) eligible New Zealand citizen 

Subclass 309 Partner (Provisional) visa

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. Getting this visa is the first step towards a permanent Partner visa (subclass 100).
It is a temporary visa
It leads directly to the permanent Partner visa
You must be outside Australia when you apply
You can stay temporarily until your permanent Partner visa (subclass 100) application is finalised or you withdraw your application.
 
With this visa, you can live, work and study in Australia while we process your permanent Partner visa. Also, you can travel to and from Australia as many times as you want. You can apply for access to Australia’s public health care scheme, Medicare.

You must

  • be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
  • have your spouse or de facto partner sponsor you
  • be outside Australia when you apply for this visa. Family who apply with you must also be outside Australia.

Subclass 100 Partner Migrant visa

The visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen, live in Australia permanently. It is usually granted to people who hold a temporary Partner visa (subclass 309).
 
In addition to what you can do on your subclass 309 visa, you can:
  • live, work and study in Australia indefinitely
  • sponsor eligible family members to come to Australia
  • apply for Australian citizenship if eligible.
  • You can stay permanently.

You must

  • hold a temporary Partner (Provisional) visa (subclass 309) or Dependent Child visa (subclass 445)
  • in most cases, continue to be in a genuine and ongoing relationship with your partner

Subclass (820 and 801) Partner visa(Apply in Australia)

 
This Visa allows the partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia.
You can apply for the temporary and the permanent partner visas together.
 
Eligibility 
 
In most circumstances, you must be the spouse (married) or de facto partner of an:
  • Australian citizen
  • Australian permanent resident or
  • eligible New Zealand citizen

Subclass 820 Partner visa (Temporary) 

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. Getting this visa is the first step towards a permanent Partner visa (subclass 801).
This is a temporary visa
This leads directly to the permanent Partner visa
This is Onshore Visa and You must be in Australia when you apply
Stay
Temporarily until your permanent Partner visa (subclass 801) application is finalised or you withdraw your application.

Subclass 801 Partner visa (Permanent)

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia permanently. It is usually only for people who currently hold a temporary Partner visa (subclass 820).
This a permanent visa and you can stay permanently
You must hold a temporary Partner visa (subclass 820)
